Updated Terms and Conditions

We’ve recently updated our: Terms and Conditions (August 1st 2018) and Privacy Policy (May 25th 2018). If you make a booking or sign up to become a Host prior to and following May 25th, 2018, we’ll ask you to agree to the new Privacy Policy when you use the Hosting Power Ltd Platform. If you make a booking or sign up to become a Host after August 1st, 2018 we’ll ask you to agree to the new Terms and Conditions. The updated Privacy Policy will automatically come into effect for all existing Hosts and Students on May 25th, 2018 and the updated Terms and Conditions will automatically come into affect for all existing Hosts and Students on August 1st, 2018. Your continued use of the Hosting Power Ltd Platform after these dates will be subject to the new Terms and Conditions and Privacy Policy. Please read these Terms carefully. If you became a Host or booked a room as a Student before August 1st all updated Terms apply to you. 

Terms and Conditions

Please read these Terms and Conditions carefully as they contain important information about your legal rights, remedies and obligations relating to your use of the Hosting Power Ltd Platform. By accessing or using the Hosting Power Ltd Platform, you agree to comply with and be bound by these Terms and Conditions.

Last Updated: August 1st 2018

These Terms and Conditions constitute a legally binding agreement between Hosting Power Ltd and you, the Host and between Hosting Power Ltd and you, the Student. These Terms and Conditions set out the rights and obligations of the international Student to be hosted by a Host in Ireland as well as the rights and obligations of the Host to host international Students in their home, in Ireland.

Modification Of These Terms

Hosting Power Ltd reserves the right to modify these Terms and Conditions at any time in accordance with this provision. If we make changes to these Terms and Conditions, we will post the revised Terms and Conditions on the Hosting Power Ltd Platform and update the “Last Updated” date at the top of these Terms and Conditions. Continued access to or use of the Hosting Power Ltd Platform and services will constitute acceptance of the revised Terms and Conditions.

Scope Of Hosting Power Ltd Services

Hosting Power Ltd is an online platform that facilities Hosts in Ireland to rent out accommodation to international Students, coming to Ireland as part of their third level or postgrad (Higher education) studies. The platform provides Students with an online marketplace of pre approved rooms to book for the duration of their stay in Ireland.

Hosting Power Ltd acts as a platform where listings are advertised for Hosts at no charge to the Host, enabling them to offer their rooms up as accommodation to international Students coming to Ireland. Hosting Power Ltd creates, uploads and manages all the listings on the Hosting Power Ltd Platform on behalf of the Hosts.

If you choose to use the Hosting Power Ltd Platform to either list your accommodation as a Host or to book a room as a Student, your relationship with Hosting Power Ltd is limited to being an independent, third-party contractor, and not an employee, agent, joint venturer or partner of Hosting Power Ltd for any reason, and you act exclusively on your own behalf and for your own benefit, and not on behalf, or for the benefit, of Hosting Power Ltd. Hosting Power Ltd does not, and shall not be deemed to, direct or control you generally or in your performance under these Terms and Conditions specifically. You acknowledge and agree that you have complete discretion whether your accommodation is listed on the Hosting Power Ltd Platform.

To promote the Hosting Power Ltd Platform and to increase the exposure of listings to potential international Students, listings and other user (both Host and Student) content may be displayed on other websites, in applications, within emails, and in online and offline advertisements.

Eligibility, Using the Hosting Power Ltd Platform

You must be at least 18 years old and able to enter into legally binding agreements to access and use the Hosting Power Ltd Platform as both a Host and a Student. By accessing or using the Hosting Power Ltd Platform you represent and warrant that you are 18 or older and have the legal capacity and authority to enter into such an agreement.

User verification on the Internet is difficult and we do not assume any responsibility for the confirmation of any Host or Student identity. Notwithstanding the above, for transparency and fraud prevention purposes, and as permitted by applicable laws, we may, but have no obligation to (i) ask Students to provide a form of government identification or other information or undertake additional checks designed to help verify the identities or backgrounds of Students, (ii) screen Students against third party databases or other sources and request reports from service providers, and (iii) where we have sufficient information to identify a Student, obtain reports from public records of criminal convictions or sex offender registrations or an equivalent version of background or registered sex offender checks in your local jurisdiction (if available).

Terms & Conditions Part One: STUDENTS

Hosting Power Ltd provides international Students with a platform to book accommodation for the entire duration of their studies in Ireland. Below are the specific Terms & Conditions which Students adhere to by booking their accommodation through hostingpower.ie

By booking accommodation through the Hosting Power Ltd Platform you are agreeing to the Terms & Conditions listed below.

By proceeding to book your accommodation in Ireland through the Hosting Power Ltd Platform, you, the Student agree that all the information you have provided, is accurate and true and that there is no reason why you should not be placed in Host accommodation in Ireland.

 

Booking With Hosting Power Ltd

The Hosting Power Ltd website is designed to help the Student find the most suitable accommodation for the their stay according to the location of the property and needs of the Student. Upon receipt of a booking confirmation from Hosting Power Ltd, a legally binding agreement is formed between you and your Host. Hosting Power Ltd cannot guarantee to fulfil all the expectations of each individual Student. Hosting Power Ltd guarantees that all the Hosts have been met face to face by a Hosting Power Ltd team member. The home and the living space where the Student will live have been visited, checked and approved by a member of the Hosting Power Ltd team.

Hosting Power Ltd only find and list Hosts that:

- Are willing to welcome and host international Students.

- Have a clean house with a safe and comfortable atmosphere.

- Offer a bedroom based on private occupancy on par with current Irish standards.

- Have clean bathroom facilities with easy access and hot water for showers.

- Offer accommodation within walking distance to shops and public transport.  

 

The Room

The Student has full and private use of their room, and use of all common areas, as designated by the Host, which at the very least should include the main bathroom (if the room doesn't come with a private bathroom) and the kitchen.

 

Use Of Household Products

All the cleaning and food products that the Students use for their own needs (i.e.: washing powder or cooking oil) must be bought by the Students themselves. It is not permitted for the Student to use any products that do not belong to them. 

 

Pets

Some of the Hosts live with a pet, usually a cat or a dog, who is considered to be a part of the family. If you have an allergy to any pets please verify that the listing you are interested in does not have any pets on the premises. Any listing that does have a pet is clearly identified as such. It is the Students responsibility to ensure the listing is pet free if they do suffer from allergies.

 

Host Environment

Every Host is unique, has a different story and a different background. They may be  with or without children, a single mother or father, a single person living on their own, of varied marital status, working or retired. Hosting Power Ltd Hosts represent an insight into the local culture and the growing diversity of Ireland. Each guest must make an effort to respect and understand these differences.

 

Once The Booking is Confirmed, The Student Agrees To:

- Contact the Host within 48 hours of the receiving the booking confirmation in order to exchange details and arrange the check in.

- Check in on the day they have booked

- Inform the Host of their schedule, if it affects the Host.

- Respect the house rules as set by Hosting Power Ltd, together with any additional, reasonable, house rules that the Host may have in place regarding the bathroom, kitchen, internet, sitting room, TV and personal belongings.

- Keep your room clean and tidy at all times. The Students are responsible for washing their personal clothes, towels, linen and for washing up their dishes after use. The cleaning rules of the common areas are to be discussed with the Host and must be shared equally by all occupants.

- Respect the laundry rules as regards to the days and times for when this service is available and number of weekly loads allowed. See the session "Use of the Laundry" below for full details.  

- Not use the landline, except in the case of a emergency.

- Inform the Host in advance if they are going to be away for two or more consecutive days.

- Inform the Host of any known medical conditions, allergies, necessary medication or emergency procedures that must be followed in case of a medical crisis.

- To not consume or partake in the consumption of any illegal drugs. It is strictly forbidden to consume or use any drugs which are illegal under Irish law for the duration of your stay.

- Assume all responsibility for any house damage that you have caused.

- Behave in an appropriate manner at all times.

- Not have any guest at the house for the duration of your stay. Having a guest is strictly not allowed. You are not permitted to bring anyone into the house at any time during your stay.  

- Not to consume any food in the Student’s allocated bedroom. All food must be consumed in the kitchen or dining area.

- Not store or consume any alcohol on the property at any time during their stay. 

 

Low Noise Policy

Hosting Power Ltd implements a low noise policy in all households. This means that Students are expected to be mindful of not making noise from 10pm to 7am, as other people in the house might be trying to sleep.

Use of the Kitchen

Students will have access to the kitchen as well as all the necessary utensils to prepare their own meals. Students are expected to clean their dishes immediately after their meals and to always leave the kitchen as clean as they found it. The kitchen is subject to restricted use as it is accessible at meals time only, with sufficient time for students to prepare and eat their breakfast, lunch and dinner.  
- The kitchen is open: From 6 am to 9 am (breakfast); from 12 noon to 2 pm (lunch) and from 5 pm to 10 pm (dinner). 
- The kitchen is strictly closed outside of those hours for students. 
- The kitchen must be used by the student to cook and eat only, it is not permitted to study etc. in the kitchen.
- The access to the kitchen can also be restricted by a maximum of one extra hour by the host during dinner time to allow the host to prepare their own meals. In such cases, the host must clearly inform the student and it must be the same hour every day (ie: 7 pm to 8 pm).

Use of Laundry

The Students are responsible for washing their personal clothes, towels and linen, therefore Students need to have access and use of laundry facilities.  The Host must allow the Student access to the washing machine up to twice (2) a week. These two washes include bed linen and towels. The Host is entitled to set up specific times and rules relating to the washing machine, as long as they permit reasonable use.

 Hosts do not need to give the Students access to the dryer but they must dedicate a space where the Student can dry their clothes or allow them to dry their clothes in their room, if suitable. The Host must give the Student access to a clothes horse. 

 

Guests

Students are strictly prohibited from bringing guests to the property, at any time during their stay. Asking the Host to make an exception on this rule will be considered a breach of the Hosting Power Ltd Terms and Conditions.

 

Duration Of Stay  

Hosting Power provides accommodation for Students, who are booking accommodation for the entire duration of their academic program in Ireland. This academic program or work placement, must have a minimum duration of eight weeks. Students staying more than ten months need to book a maximum of ten months from their check in date, as per the maximum length of booking authorised.  If the Student wishes to extend their stay beyond the time booked it is mandatory to contact Hosting Power Ltd directly by email at info@hostingpower.ie or alternatively they can make a new booking request on the website.   

 

Payment

The Student will pay a single service fee to Hosting Power Ltd in order to secure the booking. The rent will then be paid directly to the Host on a weekly basis.

 

The Service Fee

The service fee is a once-off fee charged at the time of booking. It covers all the services provided by Hosting Power Ltd to the Student, including the personal and thorough inspection of each individual property, and the assistance in any questions regarding the accommodation from the time of booking until the end of the Students stay. The service fee is calculated according to the duration of the Students studies in Ireland. To calculate the exact amount of the service fee, please select your arrival and departure dates, then select the room of choice and click on 'Book Now'. For your security, we only accept debit/credit card payments. All tax is included. 

 

Rental Fee

The Student will pay their rent on a weekly basis directly to the Host. The amount of the rental fee will vary by listing, according to the location of the property and the type of accommodation on offer. This price will be clearly indicated to the Student before the booking. The payment for the first weeks stay with the Host must be paid upfront by the Student, in cash, on the day of their arrival. Each subsequent payment will be made on a weekly basis, on the same day of the week that the Student arrived on, to the Host, until the end of the placement. The method of payment is to be decided upon between the Host and the Student. This payment method can be either cash or bank transfer. Should no discussion be had between the Host and the Student regarding payment method, the default payment method will be cash payments.   

 

Deposit

The Student must pay the Host a deposit to the value of 2 weeks of rent. The deposit must be collected on the day of the Students arrival by the host, and the Host is fully responsible for collecting it.

The deposit must be refunded by the Host directly to the Student on the day of the Students departure.

All deposits must be refunded on the day of the Student’s departure.

Hosts may only retain the deposit under the following circumstances;

- If the student does not return the room clean and in the same condition as they found it on the day of their arrival.
- If the student has caused any damage to the property.
- If the student has failed to make any of the weekly rent payments.
- If the student leaves before the end of their booking and has failed to pay the remaining days booked or the early departure fee

In the event of a dispute involving the student and the host, which directly triggers the immediate departure of the student, a 50/50 rule will be applied so that half of the deposit will be refunded to the student.  

In The Event Of A Student Leaving Before The End Of Their Booking:

If a Student decides to leave before the end of the period booked, they are required to inform their host as soon as they know of their early departure. Please also note that the rent will still be due until the end of the period booked, or an early departure fee will be applicable, as follow: 

- If the student is leaving 13 days or less before the original departure date, the rent will be still due up until the original date booked. The balance must be paid directly to the host, in addition to the final regular rental payment. 

- If the student is leaving 2 weeks or more before the end of the period booked, an early departure fee equivalent to 2 weeks of rent will be charged to the student. This must be paid directly to the host in addition to the final regular rental payment. 

 

 

In The Event Of A Student Not Being Satisfied With The Placement: 

- The Student must contact Hosting Power Ltd and explain the situation at hand.

- If the Student shows that the Host is not adhering to the terms and conditions as set by Hosting Power Ltd, and providing that the Student has respected the terms and conditions of their booking, the Student will have the option to book another Hosting Power Ltd property without incurring any additional fee. They may also choose to leave the property and request a pro-rated refund for the service fee for the unused weeks.

 

In The Event Of A Student Not Respecting The Terms And Conditions:

- If the Host can show that the Student is not adhering to the terms and conditions, is engaging in illegal activities, is rude and/or impolite, then the Host can terminate the hosting before the end of the duration booked without giving any notice. The student is expected to respect the terms and conditions from the time of booking, this includes any breach of the terms and conditions by way of correspondence with the host before check in or a 'no show' by the student. Under such circumstances Hosting Power Ltd will not place the student in another Hosting Power home nor will the service fee be refunded to the student. 

 

Cancellation 

Cancellation: By Host
- In the unlikely event of a cancellation by the Host, the Student is entitled to choose between either a free re-booking at another Hosting Power Ltd property or a full refund of the service fee. Under these circumstances, no cancellation fee will be applied.

- If the cancellation by the host is triggered by the Student making a request to the Host for something which clearly goes against the terms and conditions, this constitutes a breach in the agreement by the Student and no refund will be given. (e.g: If, after a booking has been confirmed, the Student contacts the Host to request that the Host make an exception to permit them to have a guest visit or stay overnight with them at the host's home).

Cancellation: By Student
- If a Student cancels their booking within fourteen days of the Host accepting it, the service fee will be refunded but the cancellation fee will be deducted. 
- Under any other circumstances the service fee with not be refunded

Cancellation Fee
By booking your room with Hosting Power Ltd you are entering into an agreement with Hosting Power Ltd under which you will be occupying the room you have chosen for the requested period of time. If the student breaks this agreement with Hosting Power Ltd they may be subject to the cancellation fee. The cancellation fee is fixed at €300.

 

Refund Policy

In the event of a cancellation and a refund being granted, it will be done so through the card used to make the payment. To receive a refund an email must be sent to info@hostingpower.ie from the email that was used to make the booking.

The email must read;

‘I confirm that I would like to cancel my booking at ‘listing address’, from ‘arrive date’ to ‘departure date.’

The refund will be processed within five working days of receiving the request for a refund. Please not it may take your bank additional days to process the refund. Please contact your individual bank for their specific refund time frame.

Terms & Conditions Part 2: HOST

Hosting Power Ltd agrees to provide Students to the Host and the Host agrees to accept Students under the following terms and conditions:

 

Performance

The Host confirms and guarantees that all the information presented in the Host’s application is true and complete, and are happy and prepared to welcome a Student into their home. The Host confirms and guarantees that all the points contained in the above have been fully read, understood and accepted. By agreeing to become a Host on the Hosting Power Platform, you, the Host agree that all the information you have provided, is accurate and true and that there is no reason that you would not make a suitable Host to international Students.

 

Placement

Hosting Power Ltd does not charge the Host for the services it provides to the Host. Hosting Power Ltd always strives to provide as many Students as the Host is willing to accept, but cannot guarantee that all the expectations of the Host will be fulfilled and cannot give any guarantee of Student placement.

 

Conditions of Hosting

The Host is expected to fully agree to:

- - Provide the Student with full and private use of his/her room, and access to all shared rooms, as designated by the Host, which at the very least should include the main bathroom (if the room doesn't come with a private bathroom) and the kitchen (please see section "Use of The Kitchen" for more information).

- Contact the Student by email or telephone to introduce themselves within 48 hours after the agreed placement with Hosting Power Ltd. The Host must contact the student to arrange details of the check in and provide directions to the accommodation if necessary. The Student’s contact details will be provided to the Host by Hosting Power Ltd once the booking is confirmed.

- Provide a clean, friendly and secure environment for the Student. It's important to make the Student feel at home and welcome.

- Respect the Student's cultural background(s) and to be sensitive to their particular needs.

- Provide access to good internet connection, 7 days a week.

- Provide the Student with a furnished bedroom and a private or shared bathroom. The room must be equipped with closet space, lighting and a set of bed linen. The bed must be a real and comfortable bed. No bunk beds, air mattresses, sofa beds or futons etc will be accepted. The bed and mattress should not be overused.

- Provide access to the washing machine for the student to do 2 loads a week. To set up specific times and rules relating to the washing machine, please see the section "Use Of Laundry" below for full details. Hosts do not need to give the Students access to the dryer.

- Provide the same room to the Student that was shown to and approved by Hosting Power Ltd. The Host is required to notify Hosting Power Ltd of any other room being used in its place or any major changes/renovations to the room listed.

- Give the Student their own house key from the day of their arrival and to inform them of any existing alarm codes

 - Ensure that throughout the Student’s stay, a responsible person is available and able to perform all of the requirements in this document if the Host is away from home during the Student's stay.

 - In the event of illness or injury of the Student, the Host is required to call a doctor or emergency services if necessary and to secure any medical treatment needed.

 - Keep confidential any and all sensitive information about the Student, and, if deemed prudent, to share this information only with Hosting Power Ltd

 - Have valid home liability insurance

- To Discuss The House Rules Set By Hosting Power Ltd And Any Additional, Reasonable Rules, Specific To The Individual Listing, Including:

- Use of the common areas, television, telephone, outdoor smoking areas and how the Students should maintain his/her room, if applicable. The Host will be provided with ‘House Rules’ by Hosting Power Ltd which have been designed to help the Host and Student cohabit more harmoniously. The Host is entitled to apply more specific house rules in addition to those provided by Hosting Power, once they are reasonable.

- Kitchen Use. The Student should be allowed use of the entire kitchen and all appliances in order to prepare their own meals. The Host can restrict access to the kitchen at certain times (eg: when they wish to prepare their own meal) but this time restriction should be no longer than 1 hour and no more than twice a day (e.g. no use between 11-12pm and 6-7pm). The kitchen will be closed to the Student between the house of 10pm and 7am.

- General chores. The Host may request that the Student participate in the cleaning of the common areas of the house provided that these chores are fairly divided between all the occupants living in the house. Under no circumstances are Students to be solely responsible for the cleaning of the common areas.

- Access, use and cost of the landline telephone.  The Student is not permitted to use the landline, unless there is an emergency that requires them to do so.

 

No Curfew

Please note that as all Students are over 18 years old, a curfew is not to be imposed on them.

Rental Payment

Each Host will receive rental payment made by the Student on a weekly basis. The payment for the first week’s stay with the Host will be paid upfront, on the day of arrival, in cash. Each rental payment will be made on the same day of the week that the Student arrived, and so on until the end of the placement. Hosting Power Ltd will advise the Host of the amount and the length of placement before the booking is finalised. The Host is not authorised to charge any additional fees to the Students, all bills and WiFi are accounted for in the agreed rent figure. Neither Student nor Host may lend or borrow money from each other.

 

Deposit

The Host can request a deposit to the value of 2 weeks of rent. The deposit must be collected on the day of the Students arrival by the Host, and the Host is fully responsible for collecting it. The deposit must be refunded by the Host directly to the Student on the day of the Students departure.

All deposits must be refunded. Hosts may only retain the deposit under the following circumstances; 

- If the student does not return the room clean and in the same condition as they found it on the day of their arrival.
- If the student has caused any damage to the property.
- If the student has failed to make any of the weekly rent payments.
- If the student leaves before the end of their booking and has failed to pay the remaining days booked or the early departure fee

Early Termination

- If personal circumstances arise that require the Host to terminate the placement before the end of the agreed placement period, the Host must provide the Student and Hosting Power Ltd with a 14 day notice of the termination when possible. 

- If the Student is not adhering to the terms and conditions, is engaging in illegal activities, or is rude and/or impolite, then the Host can terminate the hosting at anytime without giving any notice. 


In The Event Of A Host Not Respecting The Terms And Conditions:

If the Host doesn't respect the terms and conditions as set up in this document or doesn't respect the standards of conduct, the Student may terminate the placement without advance notice and without any extra cost to the Student. The Host will refund the Student prorated amounts paid together with the deposit and with no deductions taken before the termination date. 
Hosting Power Ltd reserves the right to remove any Host listings upon failure to adhere to the above terms and conditions.

 

Photo Release 

The Host agrees to the use of photographs taken by Hosting Power of their property. These photos will be used to create the Hosts online profile and may be used in promotion of the service in social media, advertising and other third party forums. 

 

Exclusion of Responsibility

The Host understands and accepts that Hosting Power Ltd must rely on the information provided by the Student and that most of the information and some documents may be difficult to verify. Hosting Power Ltd will never place a Student if it is known that any information may lead to suspicious or illegal behaviour, but it must be understood that the behaviour of the Student cannot be guaranteed.

The Host accepts full responsibility and risk for any injury or damage to the Host's property caused during the Host's participation in the Student's placement. The Host releases and forever discharges Hosting Power Ltd, its respective owners, agents and employees, from all actions, causes of actions, suits, claims, or demands whatsoever, that may arise from the Host's participation in the placement program.

The Host is required to check with their home insurance policy to ensure that they are covered in having an additional resident.
